TERMS AND CONDITIONS:

1. BUYER'S PREMIUM: There is a 10% Buyers Premium.

2. CONDITIONS: the information contained in this brochure and all related auction materials are subject to the terms and conditions of the CONTRACT OF SALE. Buyer's complete inspection of property is encouraged. All property sells AS IS and WITH ALL FAULTS, if any. All announcements made by the Auctioneer at the auction will take precedence over previous printed material or any other oral statements made.

3. BROKER PARTICIPATION WELCOME: Any broker actively licensed in North Carolina whose agent properly registers the successful high bidder will be paid a 1% commission based on the gavel price, at settlement by the seller. Any broker actively licensed in North Carolina whose agent properly submits an "Offer to Purchase" before the auction and is the winning bid will be paid 1.5% based on the gavel price, at settlement by the seller. Registration must be on an ArkadiA Auction BROKER PRE-REGISTRATION AGREEMENT. The properly completed agreement must be received in the office no less than 48 hours before the auction. Agent must attend sale and co-register with prospect on Auction Day. Only the first agent to register the high bidder will be paid a commission. Agents acting as principles, on behalf of other licensed real estate agents or on behalf of family members are not eligible to collect a commission. Brokers may pre-register only one potential buyer.

4. TERMS: A 10% NON-REFUNDABLE DEPOSIT is due on auction day and balance of contract price is due on or before June 14th, 2010 (Time being of the essence).

5. AUCTIONEERS DISCLAIMEER: All information contained herein is provided without representation or warranty as to the accuracy of the same. Buyers shall rely on their own judgment and inspection. Property to be sold: AS IS, WHERE IS, with all faults if any. The auction company and Sellers reserve the right to entertain any reasonable offers, which may be accepted, prior to the auction.

6. All bidders must produce a "letter of funds" from the bank insuring that you have the money to pay for your high bid. Also, you must produce a valid driver's license (Internet bidders must send a copy of valid driver’s license with bank letter). SAMPLE GUARANTEE LETTER: As a customer of out bank, we will guarantee payment of checks drawn on account #___________________ not to exceed the aggregate amount of $________________ for the purchase at the auction of ArkadiA Auction Co. on May 14th, 2010 in Fayetteville, NC.

7. ATTENTION AUCTION BUYERS: We suggest that you arrive one hour prior to the auction in order to register and have any last minute questions answered.
